Terms of Service

Welcome to Munch. By creating an account or using our platform, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. About Munch

Munch ("we," "us," "our") provides an online ordering platform that connects restaurant operators ("Operators") with their customers ("Customers"). Munch is a technology platform — we do not prepare, handle, or deliver food.

2. Acceptance of Terms

By accessing or using Munch, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the platform.

3. Account Registration

You must provide accurate, complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 18 years old to create an Operator account.
One person or entity may not maintain multiple accounts without permission.

4. For Restaurant Operators

4.1 Your Responsibilities

You are solely responsible for the accuracy of your menu, pricing, hours, and restaurant information.
You are responsible for compliance with all applicable food safety laws, health regulations, business licenses, and permits.
You are responsible for food preparation, quality, allergen information, and fulfilling orders.
You must maintain valid business authorization to operate a food establishment in your jurisdiction.

4.2 Payments & Fees

Munch charges a flat service fee to the customer at checkout. This fee is not deducted from your revenue.
Card processing fees (currently 2.9% + 30¢ per transaction) are deducted from your payouts by Stripe.
Payouts are processed through Stripe according to their payout schedule.
We reserve the right to adjust fee structures with 30 days' notice.

4.3 Account Review

All new restaurant accounts are subject to review and approval before becoming publicly visible.
We may suspend or terminate Operator accounts at our discretion for violations of these Terms.
Account deletion requests are subject to admin review.

5. For Customers

Orders placed through Munch are between you and the restaurant. Munch facilitates the transaction but is not a party to it.
Munch is not responsible for food quality, preparation, accuracy, allergens, or fulfillment.
Refund and cancellation policies are set by individual restaurants. Contact the restaurant directly for order issues.
Payment information is processed securely through Stripe. Munch does not store your card details.

6. Limitation of Liability

To the maximum extent permitted by law:

Munch is provided "as is" without warranties of any kind, express or implied.
Munch is not liable for any foodborne illness, allergic reaction, injury, or damages arising from food ordered through the platform.
Munch is not liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid to Munch (not the restaurant) in the 12 months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless Munch, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

8. Intellectual Property

The Munch name, logo, and platform design are our property. Operators retain ownership of their restaurant content (menus, photos, descriptions). By uploading content, you grant Munch a license to display it on the platform.

9. Prohibited Conduct

You may not:

Use the platform for any unlawful purpose.
Provide false or misleading information.
Interfere with or disrupt the platform's operation.
Scrape, copy, or reproduce platform content without permission.
Attempt to gain unauthorized access to other accounts or systems.

10. Dispute Resolution

Any disputes arising from these Terms or your use of Munch shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

11. Termination

We may suspend or terminate your access to Munch at any time, with or without cause, with or without notice. Upon termination, your right to use the platform ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. Continued use of Munch after changes constitutes acceptance. We will notify registered users of material changes via email.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
